This page has two parts. Part 1 covers using this website. Part 2 covers working with us, and applies to every quote and engagement.

Who we are. Avodah Creatives is a sole proprietorship (eenmanszaak) of Alysha Wazir, Amsterdam, the Netherlands. Chamber of Commerce (KvK) number 87494884, VAT number NL004436302B21. You can reach us at info@avodahcreatives.com.

Part 1. Using this website

What this site is for. This site tells you who we are and how we work, and hosts our episodes, clips and brand breakdowns. Nothing on it is an offer. Scope and price are only agreed in a proposal and a signed engagement confirmation.

Examples, not promises. The results on this site, like the spring campaign card, are examples unless a client is named. Our episodes, clips and emails share general lessons. They are not advice for your business, so don't make decisions based on them alone.

Our content. The text, video, design, logos and the line "Demand that counts." on this site belong to us or are used with permission. You're welcome to share links and quote short parts with credit to Avodah. Please don't copy, republish or use our content commercially without asking us first.

Links to other sites. We link to sites like LinkedIn, Instagram, YouTube and Spotify. We're not responsible for their content or how they handle your data.

Availability. We do our best to keep the site online and correct, but we can't promise it always will be. We may change or remove anything on it.

Liability. As far as the law allows, we're not liable for damage caused by using this site or relying on its content. Nothing here limits rights you have under law that can't be limited.

Your data. How we handle personal data is on our Privacy page.

Law. Dutch law applies to this website and these terms. Disputes go to the competent court in Amsterdam. If you use the site as a consumer, you keep the protection of the mandatory law of the country where you live.

Part 2. Working with us

Every quote, engagement confirmation and engagement is covered by our general terms and conditions. You get them with every proposal, in Dutch and English. Want a copy before then? Email business@avodahcreatives.com.

If the Dutch and English versions differ, the Dutch text prevails.

The short version

This summary helps you read the general terms. It doesn't replace them.

  • One fixed price. Every engagement has a fixed fee in the engagement confirmation. It doesn't depend on hours.
  • How you pay. 40% when you sign, 30% halfway and 30% when the report is delivered, each within 30 days. Monthly plans are invoiced monthly in advance. Prices exclude VAT.
  • Costs from others at cost. Extra production, creators and research are agreed with you first and passed on without mark-up, with the supplier's invoice.
  • Your media budget stays yours. In the first year you pay the platforms directly. We never hold your media money unless we agree a separate escrow arrangement.
  • No guaranteed results. We do our best work and track what it does to your numbers. If the numbers don't move, that's a valid result, and we report it plainly. You can't ask us to leave a result out.
  • Your numbers. We ask for read-only access to the data that shows the result, under a data processing agreement. If you don't share it, we agree that upfront and the report says the answer is less certain.
  • The work is yours once paid. All rights in what we make for you transfer to you when every invoice for the engagement is paid. We keep our own methods, templates and know-how.
  • Showing the work. We may show the work and anonymised results in our episodes and on this site, unless you say no in writing. Figures that identify you are only shared with your permission.
  • Confidentiality. We keep each other's confidential information secret during the engagement and for 3 years after.
  • Liability. Our liability is limited to direct damage and to the fee for the engagement (for a monthly plan, the fees for the last 6 months), and never more than our insurer pays out.
  • Monthly plans. A monthly plan runs for the minimum term in the engagement confirmation, then month to month with 1 month's notice.
  • Moving to a BV. We may transfer the agreement to our private limited company (BV) once we set it up. Nothing else changes for you.
  • Law. Dutch law applies. Disputes go to the competent court in Amsterdam, after we've first tried to solve them together.
